Ladies, I?ll Handle That Portfolio

Standing in front of a crowd of more than 100 members of the press at the Paley Center for Media in New York, Joan Cleveland, the vice president of business development at Prudential Individual Life Insurance presented the results of Prudential?s annual survey on women and money. The 2010 results should have been something to celebrate. More than five out of six married women surveyed reported they were either jointly or solely responsible for their household finances.

Yet Cleveland was not rejoicing. According to her interpretation of the survey, women are scared, lack confidence and desperately need help managing their money. As a result, their ?very nurturing? natures lead them to turn to often ill-informed friends and family for financial advice. Cleveland has a better idea. Women should turn their financial lives over to the pros. ?Given the complexity of the financial products that are available to women ? they really need to be encouraged to seek out that financial advice from a professional,? she said.

We?ve all heard about women?s fraught relationship with money. Women are scared of their investments, the experts say, because their relationship to money is too emotional. They don?t handle risk or negotiate as well as their male counterparts. They shop when they should save. As a result of all these fiscally improvident behaviors, they have less money than men. Even Suze Orman has deemed her fellow females financial failures, writing in her best-selling book Women and Money, ?Why is it that women, who are so competent in all other areas of their lives, cannot find the same competence when it comes to matters of money??

There is only one problem with this analysis. It?s not true.

Women have less money than men for two basic reasons: they earn less and live longer. In 2010, women earned 77 cents for every dollar earned by a man. There is no amount of education or job selection that can completely eliminate the gap.

So why bother? Well, women are an easier sell than men when it comes to promoting the value of paid advice. Ameriprise Financial, for example, found 46 percent of women had sought help with retirement planning from a financial-services professional. Men? Thirty-eight percent. Not surprisingly, taking care of the ladies is increasingly viewed as a good business model, a way to establish a profitable outpost in the money management business as women are ?a loyal and lucrative niche,? in the words of the Christian Science Monitor.

As a result, an entire industry encompassing everything from financial service behemoths to book publishers has arisen to tell women that the appropriate response to their lesser financial status is not to lobby for changes to Social Security calculations or pay equity legislation, but to hire someone to tell them how to manage their money. ?Personal finance for women falls into the whole self-help movement,? observed Mario Lin Chang, the author of Shortchanged: Why Women Have Less Wealth and What Can Be Done About It.

Wells Fargo?s ?Beyond Today Women?s Initiative? illustrates Chang?s point perfectly. On the one hand, the site is admirably honest about women?s financial lives, pointing out that women do have a harder time saving because they earn less and take financial responsibility for more people. The site points out, for example, that taking care of ailing family members costs women $325,000 in present and future income. So what should a woman do? ?Discuss your current situation ? with your financial adviser.? What that adviser can do is left unsaid, probably because the answer is ?nothing.? No amount of financial advice can compensate for $325,000 in lost salary and other benefits as a result of caretaking duties?duties that we all know are more likely to fall to women than men?any more than it can compensate for decades of earning less money than the opposite sex.

Other financial advisers promulgate what could be termed the Sex and the City approach to female finances: Those silly girls run into financial trouble because they buy Jimmy Choo shoes when they should be giving the money to Chuck Schwab instead. Take LearnVest, a woman?s financial information website. They put together ?Sh*t Girls Say about Money,? which had everything to do with shopping, spending, and not knowing how much money is in your bank account when you go to the ATM to withdraw money. No one complained about how the guy at the next desk earns more money for performing the same work.

Moreover, in reality, men surpass those mall-hopping gals when it comes to tossing the bucks around on booze and car ownership. Gallup found in 2011 that men spent $11 a day more than women. They are also easier online marks, quicker to click on the ?buy it now? button, and less likely to comparison shop or return items. Men are also more likely to buy Groupon and other coupon deals for fun, while women use the services to buy needed goods at a discount.

The patronizing attitude has not gone unnoticed by the clients. When the Boston Consulting Group surveyed women in 2009, they found an astonishing 70 percent complained about subpar treatment from financial professionals, citing everything from ?being talked to like an infant? to credentialed experts repeatedly making the assumption that the male half of a couple was the financial decision maker. A paper published by the National Bureau of Economic Research last year discovered would-be advisers were less likely to ask women about their work and financial situations than men, but were more likely to insist those same women transfer funds over to their care before discussing specific investments with them. ?This behavior might be based on the perception that women or more docile or gullible,? the paper?s authors dryly concluded.

So what can we do to improve things? As silly as it sounds, the financial services industry could start by giving women what they say they want. According to market research firm Hearts & Wallets, the things female investors were most concerned about when they sought out financial assistance included low and transparent fees, clear explanations of products and advice, and lack of sales pressure. These are eminently sensible, nonsexspecific attributes that both male and female investors would be well advised to insist on, and will likely do more to improve women?s financial position than any female-focused financial initiative.

The sun's energy is virtually limitless, but harnessing its electricity with today's single-crystal silicon solar cells is extremely expensive 10 times pricier than coal, according to some estimates. Organic solar cells polymer solar cells that use organic materials to absorb light and convert it into electricity could be a solution, but current designs suffer because polymers have less-than-optimal electrical properties.

Researchers at Northwestern University have now developed a new design for organic solar cells that could lead to more efficient, less expensive solar power. Instead of attempting to increase efficiency by altering the thickness of the solar cell's polymer layer a tactic that has preciously garnered mixed results the researchers sought to design the geometric pattern of the scattering layer to maximize the amount of time light remained trapped within the cell.

Using a mathematical search algorithm based on natural evolution, the researchers pinpointed a specific geometrical pattern that is optimal for capturing and holding light in thin-cell organic solar cells.

The resulting design exhibited a three-fold increase over the Yablonovitch Limit, a thermodynamic limit developed in the 1980s that statistically describes how long a photon can be trapped in a semiconductor.

A paper about the results, "Highly Efficient Light-Trapping Structure Design Inspired by Natural Evolution," was published January 3 in Scientific Reports, a publication of Nature.

In the newly designed organic solar cell, light first enters a 100-nanometer-thick "scattering layer," a geometrically-patterned dielectric layer designed to maximize the amount of light transmitted into the cell. The light is then transmitted to the active layer, where it is converted into electricity.

"We wanted to determine the geometry for the scattering layer that would give us optimal performance," said Cheng Sun, assistant professor of mechanical engineering in Northwestern's McCormick School of Engineering and Applied Science and co-author of the paper. "But with so many possibilities, it's difficult to know where to start, so we looked to laws of natural selection to guide us."

The researchers employed a genetic algorithm, a search process that mimics the process of natural evolution, explained Wei Chen, Wilson-Cook Professor in Engineering Design and professor of mechanical engineering at McCormick and co-investigator of the research.

"Due to the highly nonlinear and irregular behavior of the system, you must use an intelligent approach to find the optimal solution," Chen said. "Our approach is based on the biologically evolutionary process of survival of the fittest."

The researchers began with dozens of random design elements, then "mated" and analyzed their offspring to determine their particular light-trapping performance. This process was carried out over more than 20 generations and also accounted for evolutionary principles of crossover and genetic mutation.

The resulting pattern will be fabricated with partners at Argonne National Laboratory.

Lenovo IdeaCentre B540


The Lenovo IdeaCentre B540 ($899 list) is a moderately priced touch-screen all-in-one desktop PC with a decent, if unremarkable, feature set. For about $900, you get a full touch-screen Windows 8 experience on a nicely equipped, nicely designed system. It's missing a couple of future-proofing items like HDMI-in and DX11 graphics, but the B540 is certainly a decent enough machine for today, and one of the least expensive ways to get a full 1080p HD 23-inch touch-screen PC into your home.

Design and Features
Some might call the design monolithic, some might call it a black vertical slab. Whatever it is, the IdeaCentre B540 looks kind of like a mid-market HDTV, with a standard two feet and easel stand design. Its seamless glass lets you drag your fingers all over the screen, bringing up Windows 8 features like the Charms bar and the full list of apps from the Start screen. There's a little bit of drag on your finger, but otherwise the touch-screen sensors are plenty sensitive and accurate enough. The screen measures 23 inches and has 10-finger touch functionality, so you can share the screen if you're close to the person sitting next to you.

The B540 has a 1,920 by 1,080 screen, the native resolution for 1080p online videos. Unfortunately, it lacks a Blu-ray drive, so you'll need to use an external optical drive for Blu-ray movies. The screen looks fine playing back DVD movies with the tray-loading DVD burner. The screen is certainly large enough for the touch interface, particularly when you are in desktop mode, using older pre-Windows 8 programs.

The system comes with a wireless mouse and keyboard, which is pretty standard for all-in-one desktops these days. The keyboard's key caps use Lenovo's standard curved design, which is very comfortable to type on. The USB dongle for the mouse and keyboard fits snuggly in any of the system's four USB 2.0 ports. The B540 also has a pair of USB 3.0 ports, but they are on the back panel; they would be more convenient for external drives and USB keys if they were on the left (or right) side panel. The left side panel has two of the USB 2.0 ports, plus the SD-based card reader, audio ports, and the power button. The back holds the remaining USB ports, HDMI out (for an external monitor), and Ethernet. The system has a standard power port, which means that the system doesn't need an external power brick, a plus in tight workspaces. It would have been nice if the system had a HDMI-in port, so you could continue to use the B540's monitor once the PC internal components become obsolete.

The system comes with a few pre-installed programs in the Start screen, including eBay, accuweather.com, rara.com, Evernote, and Angry Birds. For the most part these additions are less obtrusive than if they had been left as icons in desktop mode. The system comes with Dolby audio enhancements, which will noticeably change the sound while listening to music and movies. The speakers themselves are loud and clear enough for a mid-sized room, though bass is fairly light. The easel-style arm in back lets you tilt the screen a decent amount backwards to accommodate tall or even standing users, but it can't be tilted to true vertical or given a negative tilt for shorter users or people who like to recline while surfing the Web. The spring-loaded arm also means that the system will eventually endeavor to come back up to a more vertical orientation, which means you'll have to readjust the system during extended touch sessions with the screen reclined. The B540 comes with a one year limited warranty.

The B540 we reviewed comes with an Intel Core i3-2130 processor, 4GB of system memory, a 1TB hard drive, and integrated Intel HD Graphics 2000. While this is all you need to do most day-to-day tasks you'd want to do with a PC, the older second-generation Intel Core i3 means that the system can't play DX11 3D games (more on that below). The system is notable because of its user serviceability. Systems like the Apple iMac 21.5-inch (Late 2012) and the Sony Vaio Tap 20 have no user upgradability or serviceability, but the IdeaCentre B540 easily sets you in to upgrade system memory (8GB max) or swap out the included hard drive for something faster, more capacious, or both. Both back panels slide off easily, giving the end users a modicum of hands-on serviceability.

Performance
Lenovo IdeaCentre B540 As stated above, the B540 comes with a second generation Core i3 processor. Most higher-priced systems come with third-generation Core processors, which feature faster clock speeds and higher end DX11 3D graphics compatibility. We're not saying that the older processors are obsolete, but you will start to run into the systems limits earlier with an older CPU. For example, the B540 matched systems like the Vizio A24T-A4 on the day-to-day PCMark 7 test, but the Vizio A24T-A4 was able to run our newer DX11 3D tests like 3DMark11 and Heaven, while the B540 couldn't run the programs at all. The B540 is similar too, if just a bit behind the Vizio, on the multimedia benchmark tests like Handbrake (video encoding) and Photoshop CS6. The Sony Vaio Tap 20 lags behind the other systems here, but that's because it uses heat-friendly and power-saving mobile components like mobile CPUs.

The B540 comes out fine against the competition, but the older processor holds it back a little in terms of performance. Sure, the older CPU allows the system come in for less money than systems like the Vizio CA24T-A4, the Editors' Choice iMac 21.5-inch, the Toshiba LX835-D3230 and its more capable brother, the Toshiba LX835-D3380, but on the other hand there isn't a lot to make the B540 stand out either, aside from the price. It's certainly a usable system, and could be recommended to anyone looking to save a few bucks on their all-in-one purchase. Whatever capabilities you give up in the 3D game grid, you'll save in dollars in the real world.

How to Pick a Career You Actually Like

How to Pick a Career You Actually LikeMost career problems stem from the fact that we are terrible at picking jobs. We think we are picking a good job and then it turns out to be a bad job. It's almost impossible to pick a good job on the first try, actually. So don't think you'll be the exception.

Economist Neil Howe says that only 5% of people pick the right job on the first try. He calls those people "fast starters" and in general, they are less creative, less adventurous, and less innovative, which makes a conventional, common path work well for them. So it's questionable whether you should even aspire to be one of those people who picks right the first try. But, that said, we all still want to be good at choosing paths for ourselves. So, here are some guidelines to think about?whether it's our first career or our fifth career.

Don't Believe the Hype

We have a grass-is-greener approach to professions that are not our own. For example, this award-winnng video from Chipotle about farmers becoming more animal-friendly pretends that it's just a mental and emotional evolution for farmers to realize that going back to nature, and being good to animals, is what feels best, so they should do it. It's so easy, for example, to take the pigs out of an assembly line.

The Chipotle video is total crap, to be honest. It's not that farmers don't know that pigs on pasture is nicer. It's that there is no market for pigs on pasture because consumers won't pay enough to eat humane meat (without farrowing crates, for example, pork prices would quadruple). So the idea that being a farmer is so beautiful and back-to-the land is just absurd. Being a farmer is actually really complicated, hard entrepreneurial work with very low wages.

Another example of a hyped up job is a lawyer. You see their exciting life on TV: a gloriously safe path from college to law school to a high paying job. But behind the scenes, each year the American Bar Association conducts a survey to ask if lawyers would recommend their profession to other people, and the vast majority of lawyers say no.

Pick a Lifestyle, Not a Job Title

Look at the lives you see people having, and ask yourself whose life you would want. That's easy, right? But now look deeper. You can't just have the life they have now. You have to have the life they lead to get there. So, Taylor Swift has had great success, and now she gets to pretty much do whatever she wants. But could you do what she did to get there? She had her whole family relocate so she could pursue her dreams in Nashville. Do you want a life of such high-stakes, singular commitment?

Look at the successful writers you read. Most of them wrote for years in obscurity, risking long-term financial doom in order to keep writing. Do you really want that path for yourself? Marylou Kelly Streznewski, author of Gifted Grownups, finds that most people who are exceptionally creative have to give up almost everything else in order to pursue "creativity with a big C." For most people, that path is not appealing.

The same is true for startup founders. It's a terrible life, to be honest. Your finances will be ruined, you won't have time for anything else in your life, and your company will probably fail. So when you decide you want to do a startup, look at the life the person had before their company got stable. Most people would want to run their own, well-funded company and control their own hours. Very few people would want the life you have to live to get to that point.

Don't Overcommit

Testing out lots of different jobs is a great idea. Job hopping is the sign of someone who is genuinely trying to figure out where they fit. Quitting when you know you're in the wrong spot is a natural way to find the right spot. A resume with lots of wrong turns is not cataclysmic. You can hire a good resume writer to fix the resume so it looks like you actually had focus and purpose. (Really, I rewrite peoples' resumes all the time. It's about telling a story and everyone has a way to tell a good story about their career no matter how many times they've changed jobs.)

The important thing is to not overcommit to one path. Graduate school, for example, is overcommiting because if you don't end up liking that field, you will have spent four years gaining entrance into the field. Taking on college debt is overcommitting because you are, effectively, saying you will ony take jobs that are relatively high paying in order to service the debt.

Buying a big house has that same effect: you overcommit to a high-earning field. Very few people want to have the same career throughout their life. Leave yourself wiggle room to switch because there is little reason to believe you'll be able to predict what you will like in the future.

Daniel Gilbert, head of the happiness lab at Harvard, has shown that evolution has ensured that we are terrible at guessing what we will like. We guess that we will like stuff that is possible for us?that looks attainable?which is what makes us keep going in life. We are generally optimistic that things will get better. This is not rational because, for the most part, things stay the same in terms of how happy we are.

Gilbert explains in his book, Stumbling on Happiness, that we have a happiness set point, and that's pretty much how happy we are today and it's how happy we will be tomorrow. But evolution has made us certain that something will make us happier tomorrow. Which means we are generally poor at predicting what will make us happy since that was not a necessary trait in preserving humanity.

Obama Promises Climate Change Action

President Obama's inauguration speech was broad, as such addresses tend to be, but he got specific when it came to climate change.

In his second inaugural address, the president mentioned the recent wave of severe weather that some have linked to global warming. From his address, as prepared for delivery:

We will respond to the threat of climate change, knowing that the failure to do so would betray our children and future generations. Some may still deny the overwhelming judgment of science, but none can avoid the devastating impact of raging fires, and crippling drought, and more powerful storms.

The path towards sustainable energy sources will be long and sometimes difficult. But America cannot resist this transition; we must lead it. We cannot cede to other nations the technology that will power new jobs and new industries - we must claim its promise. That is how we will maintain our economic vitality and our national treasure - our forests and waterways; our croplands and snowcapped peaks. That is how we will preserve our planet, commanded to our care by God. That's what will lend meaning to the creed our fathers once declared.

Talking about climate change as a pressing issue is a new thing for a presidential inaugural address. Obama made passing mention of it four years ago, during his first inaugural address in 2009, and Bill Clinton mentioned the environment.

"With old friends and former foes, we'll work tirelessly to lessen the nuclear threat and roll back the specter of a warming planet," Obama said four years ago. But today's mention seems to be the most extended case for action on climate change in any inaugural address in recent history.

Climate change was a huge part of Obama's presidential agenda, until it got derailed midway through his first term.

When Obama came into office, his legislative agenda included three major pillars - health care, energy, and education reform - as advertised by staffers at Organizing for America, the post-campaign apparatus tasked with pushing his priorities through Congress. As we saw, only health care got through Congress.

A climate-change bill, in fact, helped sink Democrats in 2010.

As prospects looked murkier for a climate bill in the slow-footed Senate, then-House-Speaker Nancy Pelosi called a vote on a climate bill that included a cap-and-trade system for limiting carbon emissions. It passed, 219 to 212, on June 26, 2009, with 211 Democrats voting in favor.

Energy reform ultimately stalled in the Senate, and the House vote proved a major political liability: Republican candidates, party committees, and outside groups hammered Democrats across the country for supporting the "cap and tax" agenda, decrying the idea of taxing businesses for emissions in a bad economy. Without action in the Senate, the Democrats' climate push proved costly politically: Democrats lost enough House seats in 2010 to hand the majority over to Republicans.

Heading into Obama's second term, near-term action on energy seems unlikely. Republicans still hold the House majority, and the makeup of the Senate has not changed significantly, meaning the prospects of energy reform have actually dimmed since the effort failed in 2009 and 2010 - when Democrats controlled both houses.

Obama's inaugural address may not signal that he intends to push legislation through Congress, unless Democrats can retake the House of Representatives, but it comes at a peculiar moment for climate-change politics: Superstorm Sandy confirmed to some that climate change is a real, tangible threat that requires immediate action, even though the legislative numbers don't quite add up.

Bundesbank: German economy picking up

BERLIN (AP) ? Germany's central bank says the country's economy, Europe's biggest, is already showing signs of picking up after contracting in last year's final quarter.

The German economy grew a modest 0.7 percent last year and officials estimate that it shrank by around 0.5 percent in the fourth quarter. But the Bundesbank said in its monthly report Monday that its prospects have improved.

The bank notes that business confidence has brightened ? powered by improving export hopes ? adding that Germany's stable labor market suggests "that economic weakness will not continue for too long."

The Bundesbank added that there are signs of the economy improving already in the current quarter. Growth in the first quarter would prevent Germany from falling into a recession.

North Korea (which recently added Google's Eric Schmidt to its guest book) will begin loosening its restrictions on foreign cellphones, allowing any arrivals to either pick up a rental phone or SIM card from service provider Koryolink. With a rental booth already set up in Pyongyang airport, you'll be able to dial out to numbers abroad, foreign embassies and international hotels. However, the SIMs (priced at around $67) won't allow you to call locals, nor will they offer any internet data -- not even EDGE. Apparently, providing data to the rental SIMs in North Korea wouldn't be a technical issue, but dependent on whether it's granted approval by the DPRK government.

My Net Wi-Fi Range Extender


Western Digital continues to make its mark into the consumer networking hardware space with the My Net Wi-Fi Range Extender ($106.25, street). This small box is designed to extend a wireless network's signal to those notorious "dead zones." The My Net Extender is an attractive device, with unique signal strength indicators to help you place it in an optimal location. Plus, it is easy to set up and does a good job of extending Wi-Fi.

Specs and Design
The My Net extender is quite small measuring 5.2" x 2.0" x 6.0 "(HWD). It's meant to operate upright on a stand attached to its base. I find its form factor more preferable over extenders that connect right into a power outlet, such as the Cisco Linksys Wireless-N Range/Extender Bridge (RE10000)
because it's easier to place the extender in different locations to get the best connection with a router.

Western Digital's device is a dual-band range extender, able to extend either a 2.4 GHz or 5 GHz wireless network. This dual-band capability gives it an advantage over many other extenders on the market, which tend to only support the 2.4 GHz band. A word of caution about extending 5 GHz Wi-Fi: the 5 GHz band is not great at sustaining throughput over long distances. Better to use the 2.4 GHz band for larger coverage areas. Using even a dual-band extender like the My Net on 2.4 GHz is more beneficial for longer-distance coverage than the 5 GHz band. Still, it's nice that you have the option of working with either band. This extender supports 802.11n and will also work with legacy 802.11x routers.

The rear panel has a power button, a Gigabit Ethernet port, a WPS (Wi-Fi Protected Setup) button for connecting to a WPS-supported router, and a toggle switch to operate the extender in either 2.4 or 5 GHz mode. On the front of the device are two LEDs; one for power and the other for wireless status which lights once the extender is successfully connected to a router.

On the side of the device is a unique feature:? 18 LEDs that indicate signal strength. The more LEDs lit, the stronger the signal. The double row of small blue lights not only looks attractive, but provides important information; as you position the extender in proximity to the router it's paired with, you can keep an eye on these LEDs to see if the signal strength drops or increases.

With the My Net extender about 30 feet away from my router, I saw 12 LEDs lit up. Moving the extender about another 15 feet closer to the router lit all 18 LEDs. The LEDs provide a handy, quick way to position the extender in the best location without having to fire up some software utility.

Configuration
The extender ships with a quick install guide and setup is indeed, quick. In fact, you can get the extender set up in only three steps. Plug it in; push the WPS button on the extender and on the router you want to connect it with; and place it in the best location using the LED signal strength indicators.

I set up the extender with Western Digital's My Net N900 router. The three steps worked perfectly. In seconds, I had the N900's wireless network extended.
Of course, a wireless extender should work with just about any router. I tested connecting via WPS to a Linksys WRT160N router.? However, the two devices would not pair using WPS. I was able to get the My Net extender connected to the Linksys router by connecting an Ethernet cable to the extender and going into the extender's web-based management interface. Connecting to the extender requires a settings change that takes a lengthy 180 seconds but otherwise, there was no issue getting the extender connected to the Linksys router using the software.

Performance
The My Net offered impressive performance on par with the excellent Cisco Linksys RE1000 extender. In the same room as the router, the My Net extender gave the fastest throughput to date, at 34 Mbps. Moving 75 feet away from the router, that throughput dropped to 4 Mbps, considerably slower. Still, 4 Mbps was enough to browse the web and is frankly, impressive in my testing environment which has heavy RF interference from many access points in proximity and lots of glass and concrete. The RE1000 did a tad better at 75 feet at 6 Mbps?not much of a difference to impact web browsing.

By the time I reached a distance of 100 feet away from the router, the My Net extender, as with the RE1000, could no longer register throughput on the Ixia IxChariot utility I use to test. I was able to surf the Internet though without too much lag. By the time I reached 150 feet, I was still connected to the Wi-Fi network, but surfing was so slow that browsing became pretty frustrating.

Below is a performance chart comparing several wireless extenders to the My Net. While you can see that BearExtender's device still registered throughput beyond using the IxChariot utility at 100 feet away from the router, only the RE1000 and the My Net actually allowed decent web browsing at that distance.

Easy Extension
The My Net RE1000 has a very easy setup, works with older routers, and allowed me to browse the web up 150 feet away from my router. It tested with slightly slower throughput than the RE1000, but it allows for more flexible positioning than the RE1000?because the device is stand-alone and not connected directly into an electric socket.

While the RE1000 is an Editors' Choice for wireless extenders because of it's negligibly faster throughput, the My Net Wi-Fi extender is a worthy alternative with the bonus of those LEDs for checking signal strength as you test where best to place the device.? The My Net Extender is an easy 4 out of 5 star earner for wireless extenders/bridges.

Tarr, GOP senators call for new drug lab oversight board

With legislative proposals coming together in advance of Friday?s biennial bill-filing deadline, Senate Republicans on Wednesday announced they?ll make a push to create a forensic services drug lab oversight board, a move intended to prevent the type of evidence tampering that recently upended the criminal justice system and eroded public confidence.

Under a proposal announced Wednesday by the four-member Senate Republican caucus, a five-member board in the Executive Office of Public Safety would have oversight authority over all state facilities involved in forensic services in criminal investigations.

The members would be the public safety secretary, attorney general, inspector general, and the state police colonel, or their designees, and one appointee to be named by the governor.

The plan comes as former state chemist Annie Dookhan faces a string of criminal charges in connection with her alleged evidence tampering at a Jamaica Plain state lab. Dookhan has pled not guilty to the charges against her.

In a statement, Senate Minority Leader Bruce Tarr said the Dookhan case had ?exposed a systemic failure in the operation of the state drug lab which demands that we take immediate action to ensure that both public safety and the prosecution of drug-related crimes are not compromised.?

India, Pakistan agree to ease tensions in Kashmir

NEW DELHI India and Pakistan agreed on Wednesday to ease tensions in disputed Kashmir by strictly observing a decade-old cease-fire after five soldiers were killed in recent clashes, an Indian army spokesman said.

The military commanders of the two armies spoke by telephone for 10 minutes and reached an understanding not to allow the situation to escalate further, spokesman Col. Jagdeep Dahiya said.

Three Pakistani soldiers and two Indian soldiers have died in the worst bout of fighting in the region since the cease-fire was signed in 2003. India said one of its soldiers was beheaded.

The series of tit-for-tat attacks had threatened to ratchet up tensions between the two nuclear-armed neighbors.

Earlier Wednesday, Pakistan accused Indian troops of killing one of its soldiers along the cease-fire line a day earlier. The Pakistani army said the shooting was unprovoked and occurred in the Hot Spring and Jandot sectors of Pakistan-held Kashmir.

However, Col. R.K. Palta, another Indian army spokesman, said Pakistani troops fired at two Indian positions using small arms and mortar fire on Tuesday night in the Poonch sector of the Indian portion of Kashmir. "Our troops didn't fire at all," Palta said.

Lt. Gen. K.T. Parnaik, an Indian commander in charge of the troubled area, said, "We want to ensure that we dominate the line of control and don't let them (Pakistanis) provoke us into making it a hot line of control."

In a sign of the rising tensions, Pakistani Foreign Minister Hina Rabbani Khar accused India of "warmongering" in a speech in New York on Tuesday. In New Delhi, Indian Prime Minister Manmohan Singh said his country's relations with archrival Pakistan "cannot be business as usual."

India and Pakistan have been rivals for decades and have fought three wars, two of them over Kashmir. The Himalayan region is divided between the two countries, but each claims it in its entirety.

Senior Pakistani and Indian officials are trying to limit the potential damage from the recent clashes to relations, which have slowly warmed since Pakistani militants killed 166 people in the Indian coastal city of Mumbai. They suspended peace talks after the Mumbai attack, but both countries have economic and other reasons for wanting better ties.

Still, the fighting along the Kashmir border highlights how easily simmering tension can flare into conflict. The biggest risk remains an attack by militants like the one in Mumbai that would likely scuttle the reconciliation process once again.

The tension has disrupted cultural and sporting ties. Performances by a Pakistani theater group were canceled in the western Indian city of Jaipur and in the Indian capital following protests by hard-line Hindu groups.

On Tuesday, nine Pakistani hockey players who came to India to participate in a tournament were sent home.

The tension comes as political turmoil is increasing in Islamabad, with Pakistan's top court ordering the arrest of the country's prime minister in a corruption case, officials said, and a firebrand cleric rallying thousands of people in the capital against the government.

On Monday, Indian army chief Gen. Bikram Singh accused Pakistan of planning the attacks that left the two Indian soldiers dead - making clear he felt it was not an unintentional skirmish - and warned of possible retaliation.

"The attack on Jan. 8 was premeditated, a pre-planned activity. Such an operation requires planning, detailed reconnaissance," Singh told reporters. He said India reserved the right to retaliate at a "time and place of its choice."

Singh urged his troops to be "aggressive and offensive in the face of provocation and fire" from Pakistan. He said the alleged beheading of the Indian soldier was "unacceptable and unpardonable" and accused Pakistan of violating the "ethics of warfare."

The Kashmir fighting began Jan. 6 when Pakistan accused Indian troops of raiding an army post and killing a soldier. India denied launching the attack and said its troops had fired across the border in response to Pakistani shelling that had destroyed an Indian home.

Two days later, India said Pakistani soldiers, taking advantage of heavy fog, crossed the de facto border and killed two Indian soldiers, beheading one. On Jan. 10, Pakistan said Indian troops had fired across the border and killed another of its soldiers. The Pakistani army said the shooting was unprovoked, while the Indian military said its troops were responding to fire from across the frontier.

Pakistan denies India's allegations and has suggested U.N. monitors in the region conduct an inquiry - a call that India rejected, saying it didn't want to internationalize the issue.

Pakistan and India struck a cease-fire agreement over Kashmir in November 2003. There have been periodic violations of the cease-fire, but the incidents during the past week have been the most serious.

In Pakistan, the Supreme Court's arrest order for Prime Minister Raja Pervaiz Ashraf on Tuesday was likely to inflame antagonism between the government and the court. The order is linked to allegations of corruption in bidding on private power stations. Ashraf previously served as minister for water and power.

The arrest order could provide ammunition for Tahir-ul-Qadri, a Muslim cleric who is leading massive protests in Islamabad to press for the removal of the government, which he says is made up of corrupt politicians.

It?s rather strange at daughter Wendie?s house.? That is where I am with Sir and the girls at the moment.. we were summonsed you see.. ?Can you come and babysit the house and dogs while we go off skiing??.. One cannot say no to?a family call if we are twiddling our thumbs can we?

It always feels OK when we go ?dan saff? to join the family, but this time the family is not there and I am defo out of my comfort zone?

When I said ?specific? on the latest Winter Wassat I didn?t mean actual specific.. what I wanted to you look at was a gate with a ring on it.. but there was one guess..

OK so you want specific! .. Just South of Norbury Junction are some narrows with stop gates in them. This is the ring on the West (towpath) side of the canal ?. North end of the gate!

And so have quite a few of you, although Nickie said a ?stop lock gate?.. it isn?t a lock but I gonna give her the tois points as she described that it could be shut from either side of the canal. Deux point to NickF and Mark & Angie take the remaining point.? Charlie you remember well!

It is indeed the stop gate at Norbury Wharf needed because there is a huge embankment to the south.? If that should breach then these gates can be closed to stop the water pouring out of the whole canal.

I find the responsibility of being in Wendie?s bricks and mortar quite daunting.? It has been over 12 years since we have lived in a house, well just me and Vic on our own.? Once I had driven them to Southampton Airport for their flight to Geneva and returned to the house I felt quite strange.

I have found that life is soooooooo quiet with not a lot to do apart from walking the four dogs.? We have taken the opportunity to visit family but by the afternoon we seem to be sitting down and watching day time tele!? Completely unknown for us to do that aboard NP..? It would be OK in the summer but the winter months must be tough for retired people I wonder what they do all day?!

For me days on the boat are always full with something or other I never seem to have time for all the things I want to do in a day, but living in this house I seem to have far to much time to do nothing! :razz:

Lucas Martins thought his manager was pranking him about UFC on FX 7 debut

Lucas Martins is making his UFC debut at UFC on FX 7 on Saturday night as a late add to the card. Justin Salas was injured in training around New Year's Eve, and Martins didn't believe it when he got the call to fill in. He told MMA Junkie he thought his management was pranking him.

"It was New Year's Day," Martins said. "I could not believe my management and the UFC were working on New Year's Day. When they called I thought, 'Is this a joke? This is New Year's Day. No one is working. They are recovering from the celebration."

Now, that would be a mean joke. Hey, Lucas your dream has just come true! Call your friends, your family and everyone who has ever helped you get to the UFC ... oh wait. We're kidding. Pretty sure I'd fire my manager for a joke like that.

A Simple Guide to Trademarks, Copyrights and Patents

Your company?s intellectual property?from your logo to trade secrets?can be just as valuable as physical assets. This is particularly true for digital startups. Yet, taking the necessary legal steps to protect your intellectual property can be costly and time-consuming, often burdening a young business before it gets off the ground. It?s a delicate balance to determine what actions to take and when, but the following is a primer on the various types of intellectual property.

Trademarks

A trademark is a word, phrase, name or symbol that identifies the source of a product or service and distinguishes it from competitors. A trademark would apply to your company name, product names, logos, and taglines.

Trademarks don?t actually have to be registered with the USPTO (U.S. Patent and Trademark Office). If your company creates a logo or name that you want to use exclusively, you can attach the TM symbol and this essentially gives you ?common law? rights. However, in case anyone ends up using your name or logo without your permission, you?ve got a much better chance of winning an infringement suit against them if you actually registered your trademark. And with formal trademark registration, it?s also exponentially easier for you to recover your digital properties?for example, if someone happens to be using a close variation of your domain name or is using your company name as their Twitter handle.

When it comes to trademarking, there?s often some confusion surrounding the company name. Many young companies think that once they incorporate or form an LLC, they have registered and protected their name. The act of incorporating does indeed register your business name within your state of incorporation?but that won?t stop someone else from using your name in any of the 49 other states.

To register your business name, you?ll need to file an application either directly with the USPTO or have an online legal filing service file it for you. Expect to pay approximately $325 in application fees per class that your mark would fall under. The process can take anywhere from six months to a year once you submit your application. It?s also smart to perform a comprehensive trademark search before starting the application process to make sure your name is available (you won?t get an application refund just because your name isn?t available).

Copyrights

A copyright protects ?original works of authorships.? For digital startups, this typically means website copy, marketing material and possibly even computer code.

By law, a copyright exists the moment something is written, photographed, drawn, etc. As soon as you write and publish the copy on your website, you automatically own a copyright for this work?and are able to use the copyright symbol ? and the terminology ?All Rights Reserved.?

If copyright protection exists without registration, why register? Formal registration is a prerequisite if you decide to sue someone for copyright infringement. That?s because copyright registration gives you a public record of ownership.

You can register online through the U.S. Copyright Office or have a legal online filing service handle it for you. Registering a copyright is relatively straightforward and affordable. So if it?s important to you to have the ability to take legal action in case someone copies part of your rebsite or whitepaper without your permission, then it makes sense to register a copyright.

Patents

A patent gives an inventor the exclusive rights to manufacture, use or sell an invention for a certain number of years. Patents cover tangible things, and can include software processes, product design and other inventions. For example, Twitter has a patent on the ?pull-to-refresh? function found in Twitter?s iPhone app, while Coca-Cola patented the unique shape of its original bottle.

Before applying for a patent, you should ask yourself the following questions: Is your product or idea original? Is it useful? And is it not obvious to others with basic skills in your field? For example, Amazon?s patent for its one-click ordering system was rejected by the European Patent Office (EPO) for being too obvious and non-inventive.

When you register your invention with the government, you get the legal right to exclude anyone else from manufacturing or marketing it. You also get to use terminology like ?patented technology? or ?patent-pending technology? (for a provisional patent) in your marketing material. And patents have value?they can be sold as assets and are often factored into funding or acquisition deals.

Acquiring a patent can take up to six years and hundreds of hours of work. Due to the complexity of the process, most companies turn to an attorney, patent agent or licensing firm?this can mean approximately $7,000 to $15,000 in attorney fees. Ideally, your IP pro will understand and specialize in your particular market, which can make the process more efficient.

Because the investment required to file a patent is so high, many startups struggle to know the right time to apply. While there?s no single right answer for everyone, keep the following things in mind.

When you submit your paperwork to the U.S. Patent and Trademark Office, you secure your priority date. This means that if another company starts doing something similar after your filing date, they?re infringing on your patent (and could be ordered to stop). If you wait?perhaps until your product is ready to launch or your company has more cash flow?you won?t have a case if someone starts doing what your patent is about. And you miss the opportunity to patent the idea or product.

In some cases, a company can spend thousands on getting a patent, only to discover that their product is not commercially viable. Or in other cases, by the time the product is finally ready for market, it has gone through so many iterations, that it?s no longer completely covered by the original patent, and the company needs to apply for a brand new patent or Continuation-In-Part application.

Be aware that the USPTO also gives you the option to file for a provisional patent. This entails a simpler and lower-cost filing procedure and lets you stake your claim for 12 months from the filing date. However, this 12-month period is non-renewable, so you?ve got to file a full patent application within the year.

No matter which IP strategy is right for you, it?s best to evaluate your options and plan your strategy early on. Filing for a trademark or copyright is often simple enough to take care of on your own or with the help of an online filing service. If patenting is in the cards, it?s best to search out a reputable patent attorney to discuss your options in your company?s early days so you?re not scrambling at the last minute.
